Issuing notice on a petition filed by the High Court Bar Association, Justice P.S. A bench headed by Narasimha sought response from the state government and others on the matter.
Meanwhile, the high court judgment will not have effect, ordered the bench, also comprising Justice Sanjay Karol.
Further hearing of the case will take place after summer vacations.
In its order, the Uttarakhand High Court had asked the Chief Secretary to complete the entire process of locating the land within a month and submit the report to the court by June 7.
The High Court said that Nainital is a famous tourist destination where traffic congestion is one of the biggest problems of the city.
"There is no private nursing home in Nainital and in emergency situations, there are no medical facilities... This Court has also come to the notice that due to lack of medical facilities, Paresh Tripathi, one of the lawyers in good practice of this Court, Caused death." It said.
In September 2022, the Full Court decided to shift the High Court from Nainital. After passing the proposal, land was identified in Golapur-Haldwani for shifting the High Court.
A bench of Chief Justice Ritu Bahri and Justice Rakesh Thapliyal said, “The identified land of about 26 hectares at Golapur in Haldwani is covered with dense forest, which is 75 per cent of the land earmarked for the high court settlors. Therefore, this court does not want to uproot any tree to create a new High Court.”
It added, "We also want the High Court to be established at a new location so that there is no need to shift it again in the next 50 years."
